01Agreement to Terms

These Terms of Service ("Terms") form a binding agreement between you and Novar Softwares (CNPJ 44.913.552/0001-66), the operator of Aller AI ("we", "our", "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you don't agree, don't use the App.

02Eligibility

You must be at least 13 years old to use Aller AI. If you are between 13 and 17, you may only use the App with the involvement and consent of a parent or guardian, who should review these Terms with you.

03Health & safety disclaimer

Aller AI is not a medical device and does not provide medical advice. The App uses an AI model to estimate whether a dish, menu item, or product may contain allergens based on a photo and the allergy profile you provide. AI-generated results can be incomplete, outdated, or wrong — ingredients can be substituted, mislabeled, or affected by cross-contact in ways a photo cannot show.

You are solely responsible for your own food choices. Always:

• Read official ingredient labels and packaging before consuming any product.
• Tell restaurant staff directly about your allergies and ask about preparation methods.
• Carry and use any prescribed emergency medication (e.g. an epinephrine auto-injector) as advised by your doctor.
• Consult a qualified healthcare professional for diagnosis, treatment, and any decisions about your allergies.

To the fullest extent permitted by law, we disclaim all liability for allergic reactions, injury, or other harm arising from reliance on results produced by the App.

04The service

Aller AI lets you photograph a menu, dish, barcode, or label and receive an AI-generated estimate of whether it's likely safe, needs caution, or should be avoided given your allergy profile, along with a restaurant-facing card you can show kitchen staff. Features, accuracy, and availability may change as we improve the App.

05Subscriptions & billing

Aller AI offers a limited number of free scans, after which continued use requires a paid subscription (monthly or yearly, including any trial, invite, or promotional pricing shown in the App). All purchases are processed by Apple through the App Store — we never receive or store your payment card details.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription anytime in your iPhone's Settings → [your name] → Subscriptions.
• Free trials convert automatically into a paid subscription unless cancelled before the trial ends.
• Refunds are handled by Apple under its own policies — we cannot issue refunds directly.
• Prices may vary by region and are subject to change with notice before your next renewal.

06Your content

"Your Content" means the photos, allergy profile, and any other information you submit to the App. You retain ownership of Your Content. You grant us a limited license to process Your Content solely to provide the App's functionality — generating scan results — as described in our Privacy Policy. We do not use Your Content for advertising or to train third-party AI models.

07Prohibited uses

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to reverse-engineer, decompile, or extract the App's underlying models or source code.
• Interfere with or disrupt the App's infrastructure or attempt to bypass usage limits or paywalls.
• Upload content that is illegal, abusive, or infringes on someone else's rights.
• Use the App's output as a substitute for professional medical advice in a way that endangers yourself or others.

08Intellectual property

The App, including its design, branding, and underlying software, is owned by us and protected by intellectual property laws. Except for the limited license to use the App as intended, these Terms don't grant you any rights to our trademarks, logos, or other intellectual property.

09Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and cancel your subscription at any time, as described in Section 5.

10Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that scan results will be accurate, complete, or error-free.

11Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of health, data, or profits, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid us in the 12 months before the claim arose, or USD 100, whichever is greater.

12Governing law

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law principles. Any dispute arising from these Terms or the App will be subject to the exclusive jurisdiction of the courts of Brazil, except where local consumer-protection law requires otherwise.

13Changes to these Terms

We may update these Terms as the App evolves. Material changes will be reflected by updating the effective date at the top of this page. Continuing to use the App after changes take effect means you accept the updated Terms.
